GENERAL RULES AND CONDITIONS OF OPERATION

Article 1 DEFINITION
- For all purposes, the parties agree to the following definitions:
- Company: Ipark Estacionamientos y Servicios de Movilidad S.A.U. with CIF A 01516640 and address at Camino de las Ceudas 2, 1st floor, Las Rozas, 28232 Madrid.
- Airport Parking Mallorca: or just Parking, managed by the Company (Ipark S.A.U.), outdoor or covered and with strict admission to third parties, and facilities of other entities that have an agreement with Airport Parking Mallorca within a 6 km radius.
- Client: Natural or legal person who will use the Parking under the conditions provided in this agreement.
- Vehicle: Motor vehicle or motorcycle that the client, under any legitimate title, has at their disposal, not including any accessory good not incorporated into it, and that can be removed.
- Airport: The Palma de Mallorca International Airport, in whose vicinity the Airport Parking Mallorca is located.
Article 2 OBJECT OF THE CONTRACT
The object of this contract is the provision of the Airport Parking Mallorca facilities and facilities of other entities that have an agreement with Airport Parking Mallorca within a 6 km radius, for the periods agreed between the client and the Company, observing the other conditions provided in the following clauses.
Article 3 DURATION OF THE CONTRACT
This contract will have the duration agreed in each case between the Client and the Company, without prejudice to the fact that this period may be extended or reduced, through communication between the parties.
In the case of prior/pre-paid reservations, cancellations with less than 48 hours' notice and schedule changes will be free of charge, but if the client wishes to modify the reservation dates, they will have to request cancellation and process their reservation again.
This contract may be automatically canceled in the following cases:
- Delivery of the vehicle later than the reserved time. If more than 120 minutes have passed since the reserved time and the client has not delivered their vehicle, the reservation will be canceled.
- Breach of contract by the client.
- If the parking staff deems it appropriate (disrespect, aggression, or repeated non-compliance with the parking conditions, ...).
Article 4 CONDITIONS
- Without prejudice to the other provisions of this Contract, upon signing it, the Clients will be assured the following benefits:
- Safekeeping of the Vehicle in the Airport Parking Mallorca, or in facilities of other entities that have an agreement with Airport Parking Mallorca within a 6 km radius for the duration of this Contract.
- Airport Parking Mallorca reserves the right to move the vehicle between the car parks and facilities of other entities that make their car parks and facilities available to it for a better optimization of the available parking spaces.
- The collection of the client's vehicle at the airport (Valet/Driver Car) to Airport Parking Mallorca and vice versa, as specifically agreed between the parties, will be carried out by duly identified and authorized company employees.
- Transport will be free of charge for the Client from the Airport Parking Mallorca to the Airport and vice-versa. This will be provided by the Company, as specifically agreed between the Client and the Company.
- Other benefits that may be provided by the Company, such as car washing, taking the car to the workshop, battery change,.... may be offered by the Company at any time and specifically agreed with the Client;
- The granting of the benefits mentioned in the previous point presupposes that:
- The key of the Vehicle will be handed over by the Client to authorized representatives of the Company, when the vehicle is dropped off at Airport Parking Mallorca or collected at the Airport (Valet/Driver Car), and it will be parked in the facilities of Airport Parking Mallorca or in facilities of other entities that have an agreement with Airport Parking Mallorca, within a 6 km radius.
- Authorized employees of the Company may, at any time, move the Vehicle within the Airport Parking Mallorca premises in order to allow the movement of other vehicles in the Airport Parking Mallorca that are being collected by other Clients, or in any case to allow the optimization of the parking spaces of Airport Parking Mallorca;
- Airport Parking Mallorca reserves the right to move the vehicles between the car parks and facilities of other entities that make their parking spaces available to the company, for a better optimization of the available parking spaces.
- The Client authorizes the driving of the vehicle from the airport to Airport Parking Mallorca or facilities of other entities that have an agreement with Airport Parking Mallorca within a 6 km radius from the airport without the need for prior agreement.
- In the event that the Client contracts the service for periods longer than one month and with periodic payments, the payments will be made by direct debit issued by the Company between the 1st and 5th of each month. In the event of a returned debit, the Company may charge the return costs to the Client.
- In the case of contracting the parking service for a fixed period, the payment will be made in advance and is due on the end date. In the event that the Client decides to collect the Vehicle before the designated date, they may do so without the right to any refund, paying the total price agreed in this Contract. If the collection is after the agreed date, the Client will pay the amount at the daily rates in force on the date of the vehicle's collection, unless expressly indicated otherwise in this Contract.
- Annual and semi-annual contracts expire at the end of the date. The client is obliged to make their own efforts to renew the contract. The letter by email and the notice that the contract is expiring are not binding and can only be considered as a service. This also means that clients cannot refer to lost email traffic when the contract expires and, possibly, to additional costs.
- In the event that the Client contracts the Battery Charging Service, the Client authorizes the Company through this Contract to connect the cables to the battery terminals.
- In the case of contracting the parking service with online payment (pre-payment). 100% of the money paid will be refunded if canceled 48 hours before the service is provided, 50% will be refunded if it is between 48 hours and 24 hours before the service. And nothing will be refunded if it is canceled with less than 24 hours' notice before the service. This cancellation will only be valid when communicated by email to info@airport-parking-mallorca.com accompanied by the corresponding reservation number. If the collection is after the agreed date, the Client will pay for the outstanding days, paying the amount at the daily rates in force on the date of the vehicle's collection.
ONLINE PURCHASE PROCESS
To purchase the Services offered on the Website, the Client must follow the instructions shown on the screen and accept the purchase by complying with said instructions.
If the Client is a natural person, they must be at least 18 years old to purchase the Services.
The contracting will be carried out by the Client completing the different forms presented throughout the purchase process and the express acceptance by the Client of these Terms and Conditions and all the conditions applicable to the contracted product. In the purchase process, once the form is completed, clicking the "Pay and Finalize Purchase" button will complete the process and will mean the full acceptance by the Client of the commercial proposal of Airport Parking Mallorca and the applicable conditions, redirecting to a purchase confirmation page on the screen, which the Client can print.
In the case of contracting the parking service with online payment (pre-payment). 100% of the money paid will be refunded if canceled 48 hours before the service is provided, 50% will be refunded if it is between 48 hours and 24 hours before the service. And nothing will be refunded if it is canceled with less than 24 hours' notice before the service. If the collection is after the agreed date, the Client will pay for the outstanding days, paying the amount at the daily rates in force on the date of the vehicle's collection.
Article 5 ADDITIONAL CONDITIONS AND PRICE
- The delivery of the Vehicle will depend on the procedure agreed between the client and the company, that is, by direct delivery at Airport Parking Mallorca or by the procedure of collecting the vehicle at the airport (Valet/Driver Car) before boarding by a duly uniformed and identified employee, always taking into account the check-in procedures referred to in Article 7.
- The reception of the Vehicle will depend on the prior request of the Client, in one of the following modalities:
- Prior indication, (through reservations) by request made online on the website, at the time of delivering the Vehicle, or by telephone communication, or e-mail, indicating: flight, airline, date and time of the client's return, with an indication of the delivery method, which may be direct (delivery at the terminal, Valet/Driver Car) or free transport from the terminal to Airport Parking Mallorca.
- By communication to a duly identified employee of the Company present at the Airport or by telephone contact with the Company, advising of the Client's presence and requesting the delivery of the Vehicle at the terminal or at the car park with free transport. The Client accepts that in this case the procedure for receiving the Vehicle may be delayed or denied.
- The price to be paid by the Client will be that which appears in the displayed price list or, failing that, the price from the online simulator (airport-parking-mallorca.com) (each fraction is 24 hours, partial periods or hours are not billed). Payment will be made online (pre-payment), or at the final act upon delivery of the vehicle, taking into account the chosen procedure (Park/Valet) and the period used (always by POS terminal, we do not accept cash.)
Article 6 CLIENT'S OBLIGATIONS
- The Client is obliged to the Company to:
- Deliver the Vehicle in full mechanical condition, in full working order and with all technical revisions and inspections, as well as with all legally required documentation (under the framework of Spanish legislation), which properly entitles the availability of the Vehicle by the Client and its movement by Company employees under the terms of clause 4.1 b) and c).
- Deliver the keys of the Vehicle (in any Park/Valet modality) that allow access to it or its mobility; the alarm remote if it is autonomous, and any other remote that allows deactivating the alarm if necessary;
- Allow access to the interior of the Vehicle and its driving by the Company's employees, under the terms and for the purposes of clause 4.2.
- Any other access to the Vehicle is excluded, with the exception of situations resulting from orders from entities with powers of authority, Police and judicial officials or with powers of public order;
- Carry out the check-in and check-out procedures provided for in clause 7, signing the corresponding documentation;
- Make sure to remove from your vehicle all belongings, goods that are not necessary for driving or parking it (in particular all personal or valuable effects).
- Authorize the Company, through its employees, to remove from the Vehicle, after its delivery, any element incorporated into it but easily detachable, such as an antenna and other accessories, which must be placed back on the Vehicle at the time of its delivery;
- The client is responsible for all damages caused by technical defects that the delivered vehicle may cause in the IPARK area.
- Pay the price of the services object of this contract under the terms of the price list in force at any time or, failing that, the price of the online simulator (airport-parking-mallorca.com);
- Authorize the company to maneuver and park the vehicle in the Airport Parking Mallorca car parks and in facilities of other entities that have an agreement with Airport Parking Mallorca, within a 6 km radius.
- In the event of an accident, clients accept the repair of the vehicle at the workshop arranged by Airport Parking Mallorca in preference to any other.
- Clients whose vehicle is on the public road, in the event of an accident, must always activate the vehicle's compulsory insurance.
Article 7 DELIVERY AND RECEPTION OF THE VEHICLE
- The delivery of the Vehicle, whether by immediate delivery at the Airport Parking Mallorca, or delivery of it at the airport (Valet/Driver Car), will take into account the following points:
- The client must deliver the Vehicle without any goods that are not an integral part of it, whether in the passenger compartment or in the trunk, namely communication equipment, radios, computers, cameras, clothes, glasses, money, etc.... or any other physically removable good; for which Airport Parking Mallorca assumes no responsibility.
- The Client and the representative of the Company must proceed with a check-in of the Vehicle, in which an inspection of the interior and exterior will be carried out, and photographic records may be taken, in order to register any damage, wear or defects existing on the date of delivery. This record will be kept by the company for up to 3 days after the vehicle is delivered.
- Likewise, if the client requests it, the subscription of the Company's reception document, in which the Vehicle's mileage, fuel level and other facts that may be relevant for the purposes of the Company's liability will be declared;
- The reception of the Vehicle by the Client, whether at the airport or at the Airport Parking Mallorca, will be preceded by a check-out of the Vehicle, with an inspection carried out by the Client, in order to confirm, if requested, the Vehicle's mileage, fuel level, etc...., as well as the absence of damage or any liability on the part of the Company. Any claim that the Client intends to make must be made at the Company's facilities in the Parking. The liability of Airport Parking Mallorca expires at the moment the vehicle leaves our facilities or is delivered in conformity at the airport terminal.
- Taking into account the reception and Check-out to be carried out under the terms of the previous clause, any claim that the Client may present regarding damage or deficiencies of the Vehicle must be submitted within a maximum period of 3 working days after the date of its reception, under penalty of forfeiture of the Client's right to claim any damages.
- In the absence of a reservation or express claim by the client at the time of the vehicle's return by the Airport Parking Mallorca valet at the airport or at the Airport Parking Mallorca car park, it will be considered that they acknowledge that their vehicle is in the same condition as it was before they handed it over. No claim can be accepted in case of violation of these formalities and deadlines by the client.
Article 8 COMPANY'S LIABILITY
- The Company will be liable to the Clients for damages negligently caused by its employees, strictly in the following cases:
- Damage caused to the Vehicle as a result of its handling within the Airport Parking Mallorca and other facilities of other entities that have an agreement with Airport Parking Mallorca, within a 6 km radius, for the purposes provided for in clause 4.2;
- Any damage suffered by the Client and their companions as a result of the transport, under the terms of clause 4.1c) d) provided that they arise from an unlawful act with gross negligence or willful misconduct on the part of the Company's employees performing the duties of driver of the transport vehicle in question;
- Any other damages that occur from an unlawful act with willful misconduct or gross negligence on the part of the employees and representatives or agents of the Company and whose liability cannot be excluded under the terms of clause 7.2;
- Airport Parking Mallorca has the right to refuse the delivery of a vehicle in its company area if possible dangers to the safety of the company IPARK Estacionamientos y Servicios de Movilidad SA are made known, by the entry or stay of said vehicle in the company's area. Likewise, it may refuse to transport people who are visibly under the influence of alcohol or other drugs (of any kind).
- The Company's liability is expressly excluded with respect to:
- Damage suffered by the Client regarding the theft of any goods left in the Vehicle after its delivery, in breach of the provisions of clause 6.1f); 7.1 a);
- Any mechanical damage to the Vehicle not caused by Company employees, including damage caused by third parties as a result of their unlawful intrusion into the Airport Parking Mallorca, notwithstanding the perimeter fences, alarm and surveillance systems installed, or by disasters or natural causes beyond the Company's control to prevent;
- The insurance policy of Airport Parking Mallorca does not cover any damage resulting from natural disasters or adverse weather phenomena.
- We are not responsible for isolated glass breakage.
- Recommendations for vehicle delivery; airlines recommend arriving 3 hours in advance for international flights and 2 hours for domestic flights. Although the reception of your vehicle and its transport to the terminal takes only a few minutes, the car park user must arrive at our facilities 20 minutes before their flight's check-in opens. We are not responsible for you missing your flight.
- The company is not responsible for the loss of your flight if you do not comply with the check-in and if you do not arrive with sufficient advance time or if the courtesy transport service is delayed, for example, due to excessive traffic, weather phenomena, delays in entering the curbside areas because they are full, etc...
- Punctuality of arrival is not part of the contract; claims for damages regarding this term are excluded.
- The company will never be responsible for any problem your vehicle has when starting, for mechanical/electrical failure, problems with the windows, flat tires or tires without air, existing damage to the bodywork or a dead battery. We only commit to helping as much as possible, and the client cannot claim for these events.
- Paint damage not caused by structural damage is excluded. Small scratches, chips and scuffs that affect the paint and/or parts of the vehicle that are not a consequence of structural damage to the vehicle (a hit and/or scrape with a vehicle, column or other object, that deforms, dents and/or displaces one or more parts of the vehicle). Also excluded is damage to the underside of the vehicle and damage that is not visible due to the dirt on it.
- Airport Parking Mallorca is not responsible for payments made to intermediaries and their return and cancellation policies, and therefore declines any responsibility in this regard.
- Damage to luggage: The company is not responsible in any case for dents, scratches, stains, broken handles, locks and/or wheels that occur on luggage during handling and transfer to the airport and vice versa.
- The company will not be responsible for damage to perishable and fragile items transported in luggage.
- Airport Parking Mallorca reserves the right to move vehicles between the car parks and facilities of other entities that make their spaces available to it, for a better optimization of the available parking space.
- Airport Parking Mallorca is obliged to refund the value of the parking only when the client misses the flight.
Article 9 CLIENT'S LIABILITY
- The Client will be responsible for any fines, penalties, or liabilities that the Company has to pay by virtue of any irregularity verified in the Vehicle, its documentation, or its ownership (within the framework of Spanish legality). Without prejudice to the rights of defense that assist the Company under the terms permitted by Law, the Client must reimburse the Company for all costs it has incurred, including legal costs with lawyers and solicitors.
- In the event that the Client fails to pay the contracted price or any other expense borne by the Company, the Company has the right of retention over the Vehicle, which will be released as soon as the amount owed is fully paid, which will include the price due by virtue of the increase in the number of days the Vehicle was parked, plus late payment interest.
- The understanding of the general rules and conditions of the service in the Spanish language. Airport Parking Mallorca is not responsible for any damages or losses that may be caused to the client or a third party due to the non-understanding of the same.
- The client agrees to deliver/collect their vehicle during the business hours of Airport Parking Mallorca (from 04:00 to 23:59 each day). If the collection/delivery is outside the business hours of Airport Parking Mallorca, the client agrees to pay a surcharge of €20 on the price.
Article 10 PERSONAL DATA PROTECTION
In accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, you are informed that your personal data will be incorporated into a data processing whose purpose is the management of the service contracted by the Company. The legitimacy is based on the consent of the Client and for the execution of this Contract. Other bodies of the State Administration, the Autonomous Community of Madrid or the Municipality where the Airport Parking Mallorca facilities are located may be recipients. Clients may exercise their rights of access, rectification, erasure, opposition, and restriction of processing by sending a written request to: info@airport-parking-mallorca.com or Camino de las Ceudas 2, 1st floor, Las Rozas, 28232 Madrid.
Article 11 MISCELLANEOUS PROVISIONS
All communications between the parties that result in a modification of this contract will be made in writing and addressed by the client to the address, fax, or e-mail of the Company and by the Company to the Client's address indicated in the particular conditions.
Article 12 JURISDICTION AND GOVERNING LAW
The validity, interpretation, and effects of this Contract/Service shall be governed exclusively by Spanish laws.
The Parties, expressly waiving their rights to submit to any other jurisdiction, submit to the courts and tribunals of the jurisdiction of Santiago de Compostela (Spain) for the resolution of any dispute, claim, or controversy arising out of or in connection with this Contract, including any question regarding its existence, validity, resolution, nullity, or effectiveness.
PRICE LIST
- MINIMUM CHARGEABLE PERIOD: 24 HOURS, ONLINE PRICES ACCORDING TO RESERVATION (PARTIAL PERIODS OR HOURS ARE NOT BILLED).
- PASSENGER TRANSPORT/COLLECTION TO THE AIRPORT: FREE OF CHARGE
- COLLECTION/DELIVERY FEE AT THE AIRPORT (VALET/DRIVER CAR): INCLUDED IN THE PRICE
- ALL PERIODS ARE 24 HOURS, EXCEPT FOR THE LAST DAY WHICH HAS A 4-HOUR TOLERANCE FOR POSSIBLE DELAYS.
- ALL PRICES INCLUDE VAT AND TAXES IN FORCE.
- PRICES ARE THOSE PRACTICED ONLINE FOR EACH MOMENT OF CONTRACTING.
- IN THE EVENT THAT THE CLIENT HAS to COLLECT THEIR VEHICLE OUTSIDE THE PARKING'S OPENING HOURS, THIS SERVICE WILL HAVE A SURCHARGE OF €20 PER STAY.
